This Participant Waiver & Release (“Waiver”) is entered into with Kinetic Flow Fitness LLC, doing business as Forged Motion Fitness, and Sally Arnold (collectively referred to as “the Company”).

ASSUMPTION OF RISK & RELEASE OF LIABILITY

I acknowledge that my participation in fitness training, group classes, personal training, open gym use, online or virtual programs, or any related activities offered by the Company is voluntary and involves inherent risks. These risks include, but are not limited to, muscle strains or sprains, fractures, falls, dehydration, cardiovascular events, equipment failure, or other injuries, including serious injury or death.

I affirm that I am physically able to participate and have no medical condition that would prevent or limit my participation. I understand that it is my responsibility to consult with a physician before engaging in physical activity and to stop participation if I experience pain, dizziness, or concerning symptoms.

In consideration for being allowed to participate, I release, waive, and hold harmless the Company from any and all claims arising out of my participation, including those caused by the ordinary negligence of the Company, to the fullest extent permitted under Ohio law. This release does not apply to willful, wanton, reckless, or intentional misconduct.

MEDICAL & NUTRITION DISCLAIMER

I understand that the Company does not provide medical advice, diagnose medical conditions, or prescribe treatment. All workouts, guidance, nutritional suggestions, meal plans, or recipes are provided for general educational and informational purposes only and are not a substitute for medical or nutritional advice.

I agree that I will consult a qualified healthcare provider regarding any medical conditions, medications, dietary changes, or concerns related to my participation and will not rely on the Company for medical advice. 

PHOTO / VIDEO RELEASE

I grant permission for the Company to photograph or record me during participation and to use such images or recordings for lawful promotional or educational purposes without compensation.

PAYMENT & CONDUCT

I understand that all payments are non‑refundable. Disruptive, disrespectful, or unsafe behavior may result in removal without refund. The Company reserves the right to refuse service.

ACKNOWLEDGMENT

I have read and fully understand this Waiver and voluntarily agree to its terms. This Waiver is governed by Ohio law and remains in effect for all future participation unless revoked in writing.
